Accessing and using this website, as well as purchasing products via contact form or email, requires reading, understanding, and accepting these General Terms of Use and Sale, which govern such use and purchases. Folicello Società Agricola s.s. may modify or update, in whole or in part, these General Terms of Use. Any changes or updates will be announced through an article in the news section and will become binding as soon as published on the website. If you do not agree, in whole or in part, with Folicello.it’s General Terms of Use and Sale, please avoid using our website.

The user is solely responsible for the use of Folicello.it and its content. Folicello Società Agricola s.s. cannot be held responsible for any unlawful use of the website and its contents by its users, except for intentional misconduct or gross negligence by Folicello Società Agricola s.s.

In particular, the user is solely responsible for transmitting untrue or incorrect information and data, false information, or data relating to third parties without their consent, as well as for any improper use of such data.

CONSUMER INFORMATION pursuant to Legislative Decree 206/2005 “Consumer Code”

The contract between Folicello Società Agricola S.s. – Via Sparate 16, 41013 Castelfranco Emilia (MO) and the consumer (Customer), considered as a distance contract, is governed by Legislative Decree 206/2005 “Consumer Code” and concerns the sale of movable goods (wine, food products).

The contract is concluded upon the transmission of a quote request and the possible subsequent confirmation of the purchase order made by the Customer via the internet or email for the goods presented through the website.

Please note that our organic products are “living” products and the same type may slightly vary from vintage to vintage. This characteristic, common to all organic products, should be considered positive because we do not offer the customer a standard, uniform product whose recipe is fixed and whose taste is preserved through chemical additives but a product that comes directly from the grapes, free of preservatives, colorants, and lovingly produced according to biodynamic principles. A product resulting from a specific type of soil, a particular climate trend of the relevant year, the care of the grower, the acidity and sugar content of each grape berry. All characteristics that may vary from harvest to harvest and make the final product unique.

All shipments are insured to protect the customer in case of breakage or loss during transport.

The shipment will always be accompanied by a regular fiscal receipt or delivery note (only upon customer request) and, unless otherwise specified by the customer, will be included inside the package.

For purchases via the Internet, the Customer may send an email to folicello@folicello.it or use the contact form at the following link www.folicello.it/contatti to request a quote and/or updated price list of the products described on the website. Once the desired types and quantities are defined, Folicello will indicate the amount for the products requested by the customer and will await the definitive order confirmation followed by the payment as indicated below.

Payment

Payment is requested upon order confirmation, by:

  • Bank transfer
  • Credit card
  • Postepay
  • Direct payment at the company shop

Folicello does not apply any additional fees; all the payment methods listed above are free of charge for the customer.

Please note that shipment will only be dispatched after payment verification and will be delivered within 24/48 hours from the shipment date.

Packaging

All our products will be packed in special cardboard to protect their contents.

We use exclusively reliable, safe, and eco-friendly packaging. The entire package is 100% recyclable.

For orders over 18 bottles, cartons will be securely placed and packed on pallets. For orders equal to or less than 18 bottles, we use secure and patented packaging: a carton for 6 bottles with internal cardboard dividers protecting each bottle.

Shipping

All our wines are transported with appropriate packaging and covered by insurance protecting the customer against breakage or loss during transport.

Deliveries will be made within 1-4 working days from the order date. The shipping cost will be indicated in the quote.

Folicello relies on the following carriers for national shipments:

  • GLS express courier – for orders equal to or less than 18 bottles (delivery expected the day after the merchandise pickup, barring unforeseen events);
  • TNTORELLO and correspondents of the D.I.F. SRL group, refrigerated truck couriers – for orders over 18 bottles on pallets (delivery expected within a maximum of 4 working days).

In case of damage to the goods during transport, products will be replaced free of charge, provided the damage is reported upon unloading and noted on the courier’s delivery note. If you receive packages visibly damaged during transport or if any goods are missing (compared to what is indicated on the DDT), you must write on the courier’s copy of the delivery note “Accepted with reserve for (reason for reserve)”. You may examine the purchased products within two days after delivery and report any damages by sending a detailed photo of the damage. We will then take care of resolving the situation with the insurance and contact you to arrange delivery of missing items or refund the amount due.

If the damage involves a large part of the order, it is also possible to refuse the goods (if the order consists of multiple cartons, you may refuse only the damaged one) by indicating on the delivery note “Goods refused due to damage.” As described above, we will take care of the return and reshipment.

In case the broken product is out of stock, you will be contacted for a possible replacement. If you do not find a replacement product in our catalog, we will refund the amounts paid.

Any return shipping costs for damaged goods and redelivery of the new ones are entirely borne by us.

After arrival, we recommend keeping our wines and juices in optimal conditions: in the dark, at a temperature between 15° and 20°C. We are not responsible for any product defects caused by the customer’s negligence.

Returns and Right of Withdrawal

Conditions of the right of withdrawal and return:

The purchased goods must be substantially intact: returned in the original packaging, intact, unopened and unused.
The right of withdrawal is reserved only for individuals, excluding purchases made by resellers or entities buying for resale purposes.
Shipping costs are borne by the customer.
Upon arrival at the warehouse, the goods will be inspected to assess any damages or tampering; therefore, please ensure careful packaging, for example by using the original packaging.
To exercise this right, the customer must send us a communication within 10 days from the receipt of the ordered goods and send the goods back within a further 15 days.

Information on the right of withdrawal:

Purchases made via internet or email are subject to Legislative Decree 206/05, which guarantees your right to withdraw for any reason from the purchase contract.
To exercise this right, you must follow the procedure below:
Send an email to folicello@folicello.it containing the declaration of intent to exercise the right of withdrawal, attaching the confirmation email of the order and indicating the following data:

  • Invoice or receipt number
  • Which products are subject to withdrawal (identifying them with the article code on the left column of the invoice or receipt)
  • Your bank details (IBAN code)

You will then receive authorization to return the goods.

After receiving such authorization, you must send back the goods within 15 days to:

Refund times:

We commit to refund the customer within one week of receiving the goods by crediting the amount corresponding to the value of the goods shown in the invoice. This amount does not include shipping costs for both the initial shipment and the return shipping costs the customer must bear. This is in accordance with Legislative Decree no. 206 of 6/09/2005.
